Workers Compensation Benefits
When to Seek Legal Advice
Any time a serious injury occurs while on
the job, it is wise to promptly seek legal
advice from an attorney. An experienced attorney
can stand up to the insurance companies that
are only looking out for your company's interests
and help you receive the full amount of compensation
you are entitled to. The following situations
demand that you seek legal advice:
Your case has not been filed and:
- You're not sure how to fill out the forms
- Your employer has denied that you were
injured while on the job
- You are without income
- Your employer does not carry compensation
insurance
Your case has:
- Been accepted, but you are out of work
and not receiving weekly checks to cover
wage loss
- Been neither accepted nor denied, and neither
the employer nor insurance company will respond
to you
- Been accepted, but you are being required
to do work that causes pain or which you
are not able to do properly because of your
injury
Your Wages have been:
- Understated by insurance company and your “compensation” rate
is low (Usually, you only receive about 2/3
wages and that is your compensation rate.)
- Reduced because you had to take a lesser
paying job when you returned to work, and
your employer or insurance company will not
make up the difference in wages
Your medical care:
- Is not adequate
- Has been denied. has been stopped because
your treating doctor “released” you
when you still need additional medical treatment
- Has provided a disability rating for your
injury, but you believe you are entitled
to a greater disability rating
The insurance company has:
- Requested an interview, which will be recorded
- Promised compensation, but you have not
received any
- Made a settlement offer that is low, and
you don't have any idea whether it is a fair
settlement or not; or you suspect an unfair
settlement
- Sent you a Notice of Denial with a very
tight time frame to appeal
Your employer has fired you because of your injury which
is a violation of federal law.
You are not sure of your rights and want the guidance
of an experienced attorney to help you through the maze
of workers' compensation.
