Drugs and Profit$—Mixing Greed and Errors

cash, prescriptions and a stethoscope“According to a report by the Center for Public Integrity, congressmen are outnumbered two to one by lobbyists for an industry that spends roughly $100 million a year in campaign contributions and lobbying expenses to protect its profits.”—Under the Influence, a 60 Minutes Report by CBS

When prescription drugs are rushed to market for maximum profits, medication errors can occur. The long-term effects of prescription medications are often difficult to determine, especially with inadequate testing. Many tests that the general public may assume are performed by the FDA are actually conducted by laboratories that are funded by the drug manufacturer itself (self-testing).

In some instances, people suffer injury or death before a drug recall is instituted. When an injury occurs and a lawsuit is filed, the case will be based on personal injury law and typically fall into subcategories such as pharmacy or pharmaceutical injury, product failure, or medical malpractice/negligence law. If a person dies due to a medication, a wrongful death case may be filed.
